Boulder Community Network Information Provider Contract

Before putting any information on the Boulder Community Network (BCN), information providers are required to sign this contract indicating that they have read, understand and will comply with the terms herein.

This contract is in accordance with broader BCN policy found at http://bcn.boulder.co.us/bcn/policies/policy.html which contains detailed information on the distinction between BCN's role of 1) serving information and 2) providing links to information served by others. These policies are intended to protect BCN from liability for information created by other organizations/individuals and stored on the BCN server.

Commercial Information

Commercial information is not permitted on the BCN server with the exception of chosen business "incubator" projects. For more information about incubation projects see http://bcn.boulder.co.us/bcn/policies/incubation.html. Commercial information is defined as that directly related to "for profit" enterprises. However, pages which reside on the BCN server may include "links" to commercial information and businesses whose pages reside on other servers. In addition, BCN encourages educational information which may be of assitance to area businesses (i.e. tax assistance, training and management resources etc.)

On-line Financial Transactions

BCN will support on-line financial transactions for tax-exempt 501 (C) 3 non-profit organizations. These transactions are further limited to those which do not involve the sale or exchange of tangible goods or services (with the exception of periodic newsletters or "membership premiums" in the exchange for membership dues or donations).

Obsenity

Any material that is deemed obscene under Colorado law may not be posted on BCN.

Libel, Hate Messages, and Violence

Information Providers will not post libelous material, hate messages, nor material that incites or advocates violence.

Editorial Rights and Responsibilities

The Information Provider assumes all editorial rights and responsibilities. In the case where an information provider contracts with an outside web developer or BCN volunteer for page development assistance, the information provider still assumes all responsibility for the content of all their pages posted on BCN. In the case that an information provider runs any software or applications on the BCN server, again, responsibility remains with the information provider.

Copyright Laws

Information providers agree to comply with current state and federal copyright laws. Copyrighted information may not be posted on BCN without the permission of the copyright holders. Submission of content to BCN is done at the information providers risk. The information provider, not BCN, is liable for all damages resulting from any infringement of copyrights or any other harms. It is the information provider's responsibility to ensure accuracy and appropriate content. The information provider shall defend, indemnify, and hold harmless BCN in all cases arising out of any defamatory or illegal, or allegedly defamatory or allegedly illegal material placed in the BCN server.

Non-Compliance

If an information provider does not comply (in the opinion of the BCN Coordinator) with the above terms, their information may be removed without notice. The provider may appeal their case to the BCN Board of Directors whose decision is final.

Timely and Accurate Information

The information provider is responsible for maintaining the accuracy and timeliness of information. The information provider will conduct periodic reviews of their information on BCN and adjust the content to maintain continued relevance, accuracy, and accessibility. Under no circumstances will BCN be liable for any loss or damage caused by a user's reliance on information obtained on the BCN server.
